Will of Ann Saer (1846) of Cooper’s Lake, Manorbier

This is the last Will and Testament of me Ann Saer the Wife of John Saer of Coopers Lake in the Parish of Manorbeer in the County of Pembroke to take effect from and immediately after the decease of the said John Saer in the event of his surviving me I give and devise all those fields pieces or closes of Copyhold Land called Big Mead Meadow and Little Mead Meadow being part of my real Estate situate in the Manor of Manorbeer in the said County of Pembroke unto my daughter Mary Anne Saer her heirs and assigns for ever I also give and devise all that piece or parcel of Land called the Lower Croft together with four roods or stangs to be taken and marked out from the lower part of a piece or parcel of Land called the Long field other part of my said real estate and situate in the said Manor unto my daughter Esther Saer her heirs and assigns for ever And I give and devise unto my daughter Caroline Saer her heirs and assigns for ever from and after her attaining the age of twenty one years or being married which shall first happen All that piece or parcel of Land called the Upper Croft together with One Rood or Stang of ground to be taken and marked out of the middle part of the said Field called the Long field situate in the said Manor And I give and devise unto my daughter Maria Saer her heirs and assigns for ever from and after her attaining the age of twenty one years or being married which shall first happen All the remaining part of the said field called the Long Field together with a piece or parcel of Land called Mans Invention also situate in the Manor aforesaid And I give and devise unto my daughter Pamela Saer her heirs and assigns for ever from and immediately after her attaining the age of twenty one years or being married which shall first happen All those pieces or parcels of Land called the Heath and Moles hole situate in the Manor aforesaid And I give and devise unto my daughter Adelaide Saer her heirs and assigns for ever from and immediately after her attaining the age of twenty one years or being married which shall first happen All those two fields or parcels of Land called Newton Meadow and the West Meadow adjoining to Coopers Lake house And I likewise give and devise to my daughter Bridget Saer her heirs and assigns for ever from and after her attaining the age of twenty one years or being married which shall first happen All those two pieces or parcels of Land called Hop Garden and Clay Field situate in the Manor aforesaid And lastly I give and devise unto my Son William Edgworth Prichard Saer his heirs and assigns for ever from and immediately after his attaining the age of twenty one years All that Messuage or Tenement with the Garden Orchard Outbuildings and appurtenances thereunto belonging called Coopers Lake together with four pieces or parcels of Meadow Land situate to the south of the said House and in the Manor aforesaid And lastly I hereby direct my eldest daughter the said Mary Anne Saer shall until each and every of my Children aforesaid excepting the said Mary Anne Saer and my second daughter Esther Saer shall attain their respective ages of twenty one years or be married have receive and take the rents issues and profits of all and singular the hereditaments and premises hereinbefore devised and do and shall pay and apply the same in and towards the maintenance education and support of my said Children respectively and in the event of any or either of my said Children dying before they have respectively attained the age of twenty one years or been married I give and devise the before mentioned share and shares of my said Real Estate equally to be divided between and amongst the survivors of my said Children share and share alike as Tenants in Common and not as joint Tenants And I direct my Executrix hereinafter named to maintain a home and provide for all or any of my said Children who at the time of my decease shall  not have attained the age of twenty one years or been married until they or any of them shall respectively attain such age or be married which shall first happen And I appoint my said daughter Mary Ann Saer sole Executrix of this my Will hereby revoking all former Wills by me at any time made and declaring this to be my last In Witness whereof I have hereunto set my hand this Twenty fourth day of October One thousand eight hundred and forty five

Deceased, who died on the 26th day of October One Thousand Eight Hundred and 1845 and MADE OATH, that the Estate and Effects of the said deceased, for or in respect of which a Probate of the said Will is to be granted, (exclusive of what the Deceased may have been possessed of, or entitled to, as a Trustee for any other Person or Persons, and not beneficially, but including the Leasehold Estates, for years of the Deceased, whether absolute or determinable on Lives, and without deducting any thing on account of the Debts due and owing from the Deceased,) are under the Value of Twenty Pounds to the best of this Deponent’s knowledge, Information and Belief.

Know all Men by these Presents that We William Clerk of Velinvach in the parish in the parish of Llanfihangel Abercowin in the County of Carmarthen Miller, William Morris of Llain in the parish of Mydrim in the said County Carpenter and David Evans of Gorsyn?or in the parish of Llangunnock in the said County farmer, William Brown of the parish of Llanvihangel Abercowin in the said County farmer are held and firmly bound unto the Right Reverend Father in God Thomas by Divine permission Lord Bishop of Saint Davids in the sum of Two Hundred and forty pounds of good and lawful Money of Great Britain to be paid unto the said Lord Bishop or to his certain Attorney his Executors Administrators or Assigns To which Payment well and truly to be made We oblige ourselves and each of us by himself and themselves for the whole our and each and every of our Heirs Executors and Administrators firmly by these Presents Sealed with our Seals Dated the first day of November in the Fifty Seventh Year of the Reign of our Sovereign Lord George the third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith &c  And in the Year of our Lord One Thousand Eight Hundred and Seventeen.

Clark and William Morris Guardians Administrator of all and singular the Goods, Chattles and Credits of Thomas Griffith Farmer deceased do make or cause to be made a true and perfect Inventory of all and singular the Goods Chattles and Credits of the said deceased which have or shall come to the Hands Possession or Knowledge of them the said William Clark and William Morris or into the Hands and Possession of any Person or Persons for them and the same so made do exhibit or cause to be exhibited into the Registry of the Archdeaconry of Carmarthen at or before the last day of April next ensuing and the same Goods Chattles and Credits and all other the Goods Chattles and Credits of the said deceased at the time of his death which at any time after shall come to the hands or Possession of the said William Clark and William Morris or into the hands and Possession of any other Person or Persons for them  do well and truly administer according to Law And further do make or cause to be made a true and just Accompt of their said Administration at or before the last  day of October and all the Rest and Residue of the said Goods Chattles and Credits which shall be found remaining upon the said Administrators Accompt the same being first examined and allowed of by the Judge or Judges for the time being of the said Court shall deliver and pay unto such Person or Persons respectively as the said Judge or Judges by his or their Decree or Sentence pursuant to the true Intent and Meaning of a late Act of Parliament made in the two and twentieth and three and twentieth Years of the Reign of our late Sovereign Lord King Charles the Second intituled an Act for the better settling of Intestates Estates shall limit and appoint And if it shall hereafter appear that any last Will and Testament was made by the said deceased and the Executor or Executors therein named do exhibit the same into the said Court making Request to have it allowed and approved accordingly if the said William Clerk and William Morris above bounden being thereunto required do render and deliver the said Letters of Administration (Approbation of such Testament being first had and made) in the said Court then this Obligation to be void or else to remain in full Force and Virtue.

Charlotte Saer of the Town of Laugharne in the Parish of Llanstephan in the County of Carmarthen widow in order to the due Administration of the Personal Estate and Effects of Elizabeth Meyrick late of the Parish of Llanstephan and County of Carmarthen who died on the seventh Day of February 1827 Intestate maketh Oath and saith That she has made diligent Search and due Inquiry after and in respect of the Personal Estate and Effects of the said deceased, in order to ascertain the full Amount and Value thereof, and that to the best of her Knowledge, Information, and Belief, the whole of the Goods, Chattels, and Credits, of which the said deceased died possessed, within the Diocese of Saint David’s (exclusive of what the deceased may have been possessed of, or entitled to, as a Trustee for any other Person or persons, and not beneficially, but including the Leasehold Estates for Years of the deceased, whether absolute or determinable on Lives, and without deducting any Thing on Account of the Debts due and owing from the deceased) are under the Value of Twenty Pounds.  And this Deponent further saith That the said deceased had no Personal Estate and Effects at the Time of her Decease, within the Province of York, to which this Deponent needs to administer.

This is the last will and Testament of me John Thomas of Court in the parish of Pembrey in the County of Carmarthen Gentleman In the first place I will and direct that all my just Debts funeral and Testamentary expences to be fully paid and satisfied by my Executrix and Executor hereinafter named  I Give and bequeath all and singular my Stock and Crop Household Furniture Chattels and Effects of or belonging to the farm called Court where I now reside of which I shall be possessed at the time of my decease unto my beloved wife Anne Thomas and my youngest son William Thomas now of Maesydaven in the parish of Llanelly in the County of Carmarthen their Executors and Administrators upon Trust that they do within Twelve Months next after and from the time of my decease by sale or otherwise of the same raise the sum of Three Hundred Pounds and I will and direct that the said William Thomas his Executors and Administrators do and shall place the said sum of Three Hundred Pounds when so raised and at Interest upon Landed or Government Security to and for the benefit of the child or children (if more than one) of my son David Thomas of the Village of Pembrey in the County aforesaid shopkeeper by Margaret his present wife and that he the said William Thomas his Executors or Administrators do and shall receive and pay the Interest of the said sum of Three Hundred Pounds every year to my said son David for and towards the Maintenance and education of his said Child or children if more than one until he she or they respectively shall attain the age of Twenty one years and upon his her or their severally attaining that age do and shall receive and pay to each of my said Grandchildren one equal part or share of the said principal sum of Three Hundred Pounds Together with all revenues of Interest if any that may then be due in respect thereof the same to be equally divided between them whether sons or daughters And in Case my said son David shall happen to depart this life before all or either of my said Grandchildren shall respectively attain his or her said age of Twenty One years I do further will and direct that my said son William shall be and I do hereby Constitute and appoint him Guardian and Trustee for such of my said Grand Children as shall be under Twenty One years of age so far as

Respects the said sum of Three Hundred Pounds and the application of the Interest thereof until such Grandchild or Grand Children attain his her or their said age of Twenty one years And I will that my said Grand Children shall have benefit of survivorship And in Case of the death of all my said Grand Children under the age of Twenty One years I will and direct that the said sum of Three Hundred Pounds shall be immediately thereupon received and retained by my said son William Thomas to and for his own proper use and benefit And Subject to the payment of my just Debts and funeral and Testamentary Expences and to payment of the said sum of Three Hundred Pounds I Give and bequeath all the aforesaid stock and Crop Goods Chattels and effects and all monies that may arise from the sale thereof unto and between my said beloved wife Anne Thomas and my said son William Thomas share and share alike and to and for their own joint use and benefit But in case my said wife and my said son William should not agree to live together at Court farm or my said wife should be minded or desirous to reside elsewhere In either of these cases I will and direct that the whole stock and Crop Goods and Chattels and Effects of and belonging to the said farm of Court be forthwith appraised and valued by four indifferent persons two be chosen by each party and that such Valuation be taken down in writing and that my said son William do thereupon bind himself in sufficient and responsible sureties to pay my said wife Interest for one third part or portion of the total amount of the said Valuation such Interest to be payable at four equal times in every year during the natural life of my said wife and after the rate of Five Pounds per Centum per annum and that immediately after such Valuation and security given my said wife shall quit possession of the said farm of Court and give the same up together with all the aforesaid stock and Crop and Goods Chattels and Effects to my said son William  I give and bequeath to my said son William Thomas the sum of One Hundred and Fifty Pounds of lawful British money payable within three years next after my decease in manner hereinafter mentioned   I Give and devise all those several Stangs Fields and parcels of Land which I lately purchased of Thomas Lewis of Llandilo in the County of Carmarthen Esquire and which were formerly part and parcel of the

Estate called Stradey Estate which said Stangs Fields parcels of Land now form part of the said Farm called Maesydavan and are situate lying and being in the said parish of Llanelly in the said County of Carmarthen and in the Occupation of my said son William Thomas as my Tenant unto William Williams of Moreb in the parish of Llanelly aforesaid Gentleman his Executors Administrators and Assigns to have and to hold the same for and during the term of Five Hundred Years upon Trust by sale or Mortgage thereof to raise and levy or take up at Interest at the expiration of three years from the time of my decease the sum of One Hundred and Fifty Pounds of lawful British money and pay the same when so raised unto my said son William to and for his own use and benefit And Subject to the said Term of Five Hundred Years and to the Trust thereof I Give and devise the said Stangs and premises unto my eldest son John Thomas his Heirs and Assigns for ever  And I do hereby nominate and appoint my beloved wife and my said son William Joint Executrix and Executor of this my will hereby revoking all former Wills and do declare this to be my last Will and Testament  In Testimony whereof I have to the first and second of these sheets of paper set my name and to this last sheet set my hand and seal this Sixth day of February in the year of our Lord One Thousand Eight Hundred and Twenty Nine

In the Name of God Amen I David Hay of the Town and Borough of Tenby and county of Pembroke mariner being in a tolerable good state of health and of sound mind memory and understanding but aware of the uncertainty of human life and to prevent all disputes and litigations after my decease do make and declare this my last will and Testament in writing in manner and form following that is to say I give devise and bequeath unto my dearly beloved wife Mary Hay all and singular my real and personal Estate or Estates of what soever kind or description ??? same may be or wheresoever situated together with all my Goods Chattels and Effects of any and of every kind they may be of which I may be possessed or entitled to at the time of my decease that is to say in particular first all the rights and title to that freehold part of my Estate consisting of the house I now live in and enjoy situate in Bridge Street in the Town of Tenby and County aforesaid commonly called and known and now bearing the Sign of the princes head public house with that of the Garden situate lying and adjoining Serjeants Lane in the said Town of Tenby with all their singular appurtenances priviledges and appendages thereunto belonging as also a thorough Claim to and right and Title in the one eighth part of the Sloop John and Mary of the port of padstow in the County of Cornwall and further all the entire Right to the Fishing Trawling and Piloting Boat I now have or that or ???? I may then own and possess with all the geer materials and Tackling and also to all my household Furniture Goods Chattels and Effects of what kind or description soever the same may be to have hold  enjoy and enjoy the same after my decease without claim Let or molestation from or by any of my Children relations person or persons whomsoever for and during the corse of her natural life after the payment of all my just Debts and Funerals Expenses are paid and satisfied with full authority and power to will devise and bequeath the same after her decease between and amongst or three Children now living or their Children or the survivor or survivors of them as she may think most and proper and I further constitute and appoint my said wife Mary Hay sole Executrix of this my last will and Testament hereby revoking and disannulling all wills by me at any time heretofore made satisfying ?confirming this and no other for and as my only last will and Testament contained in this one sheet of paper and made and executed this twenty ninth? day of April and in the year of our ???? one thousand eight hundred and twenty David Hay Signed sealed published and declared to be the last will and testament in writing of the said Testator David Hay who in his presence and at his request and in the presence of each other have as witness subscribed our names hereunto Wm Rees Senr / William Davey/ Abm Thomas witnesses all of Tenby.

PROVED at London 4th July 1821 before the Judge by the oath of Mary Hay widow the Relict and sole Executrix to whom which was granted having been first sworn by Executor duly to admn.

In the name of God Amen I David William at Colman in the Borough of Kidwelly in the county of Carmarthen Farmer being weak in Body through Illness, but of Sound Mind Memory and understanding thank God Do make this my last Will and Testament in manner and form following
First I give demise and bequeath to my son John William the Lease of Colman and the Lease of Parc Jolliff ie and the Sum of one Shilling, the shilling to be paid by the Administrator or Executor hereafter mentioned
Secondly I give to my Daughter Mary the sum of Five Pounds being the wife of Capn John Anthony now residing at Carmarthen to be paid by my appointed administrators or Executor hereafter mentioned in two years after my decease
Thirdly I give my Daughter Elizth wife of Capn John Charles at Kidwelly the sum of Five Pounds to be paid by the same and the same time as to the above mentioned, my Daughter Mary viz in two years after my Decease
Fourthly I give to my Daughter Margaret wife of Francis Randell the sum of Twelve Pounds to be paid by the same and at the same Period as the above my two other daughters, in two years after my Decease
And Lastly I give Devise and bequeath to my son David William the Eight Part of the Sloop Elizabeth and Ann which I hold, and also to the said my son David William all and the whole of my stock, crop, Household furniture, wearing apparel, and the Lease which I bought of Mr Samuel Jones of Llaynsholiff and all and everything that is or will be due to me in any wise whatsoever either at present or in ??? to the said my son David William and I do hereby nominate and appoint the said my son David William to be the whole and sole Executor of this my Last Will and Testament declaring this to be my last will and Testament and no other – that is to say that I dissanull and disallow all will or wills heretofore made by me

Appeared Personally Margaret Thomas of Highway [sic] in the Parish of Llanelly in the County of Carmarthen Widow and deposed by virtue of her Corporal Oath as follows (that is to say) that she is the Sole Executrix named in the last Will and Testament of the said William Thomas late of Halfway aforesaid Collier deceased and the Party applying for Probate thereof that she said deceased died on or about the third day of March in the year of our Lord One thousand eight hundred and forty three and that the reason why the said Will was not presented for Probate by this deponent before the expiration of the Five Years from the death of the said Testator was that the Deponent was so shocked at the Accident the Testatee met with on the day of his death, as to be incapacitated for years to attend to her Affairs; and that she was utterly ignorant respecting the time within which she was to present the Will for Probate. Appeared Personally David Arthur Davies of the Town of Llanelly in the Parish of Llanelly in the County of Carmarthen Surgeon and made oath that he is one of the subscribed witnesses in the last Will and Testament of William Thomas late of Halfway in the Parish of Llanelly in the County of Carmarthen aforesaid Collier deceased hereunto annexed the said Will beginning thus “This is the last Will and Testament of me William Thomas of Halfway House in the Parish of Llanelly in the county of Carmarthen being of sound mind and memory made this third day of March 1843” ending thus “and the last seventh share for my dear Wife Margaret Thomas forever. Signed and sealed in the presence of us the undersigned this third day of March one thousand eight hundred and forty three and in the presence of each other” and thus subscribed William Thomas by X his mark and with reference to the execution of the said Will made Oath that on the day of the date of the date of the [sic] said Will the said Deceased signed the same by subscribing his mark hereto in the presence of this Deponent and his fellow subscribed witness David Jones who were both present at the same time with the said Deceased and on the Deceased so executing the said Will in their presence thus immediately in his presence at his


request and in the presence of each other set and subscribed their names as Witnesses thereto as now appears thereon and this deponent further made Oath and said with reference to the Word “my” struck out in first line and the Word “she” interlined above thereof the Worlds “third day of March 1843” interlined between the third and fourth lines, the Words “my last Will & Testament” struck out in the said fourth line the Word “Son” interlined between the fifth and sixth lines the Words “to be ‘paid” struck out in the tenths line, the Word “be” interlined between the fifteenth and sixteenth lines the interliniation between the twenty third and twenty fourth lines (that is to say) the Words “and ‘Mary Ann my’ struck out, the Word “and” struck out in the said twenty fourth line, and the Word “that” struck out in the twenty ninth line of the first side of the said Will that the said Words were so struck out and interlined as aforesaid as now appears prior to the said deceased so executing the said Will and this deponent and the said David Jones his said fellow Witness attesting the same and that the said Will in those and all other respects is now in the same plight and condition as when so executed and attested.

In the name of God Amen. I Oliver Mathew of the parish of Pembrey
in the County of Carmarthen yeoman being sick in body but of
sound & perfect mind & memory praise be to God but calling to
mind the uncertainty of this life on earth, doe make & ordaine
this my last will & testament in maner & forme following that is to say
first & principally I commend my soul into the hands of the Almighty
God my Creator Hopeing assuredly through the …………..death & passion of blessed Lord
Jesus Christ my saviour & redeemer to receive full pardon & free
absolusion of all my sins & my body to the earth to be buried by my
Executors hereafter mentioned after a Christianlike & desent maner
att the parish Church of Pembrey and as touching such worldly
goods & estate as the Lord of his tender mercy was pleased to
bestow upon me here, my will is to dispose of the same as followeth
In Primis I give & bequeath towards the repairation of the Cathedral
Church of St Davids the summe of foure pence to be paid by my
Executors hereafter named within one month next after my decease
Item I give & bequeath to the poore of the said parish to the value of
ten shillings of bread to be distributed amongst them by my said
Executors within one month next after my decease. Item I give &
bequeath unto my sister Rachell the summe of twenty shillings to
be payed by my said Executors within three months next after
my decease. Item I give & bequeath unto my sister Margarett the
sume of twenty shillings to be paid by my said Executors within three
months next after my decease Item I give & bequeath unto my
sister Eleanor the summe of twenty shillings to be payd by my said
Executors within three months next after my decease. Item I give
& bequeath unto David Harvey my nephew the sume of twenty
shillings to be payd by my Executors within three months next
after my decease. Item I give devise & bequeath unto my sister
Anne & Mary her reputed daughter commonly called & known by the
name of Mary Jenkin All that house & garden & parcells of
land called Cwm Gola [?] & Cwm Issa with all its rights me….bers &
appurtenances & all other my houses & lands sittuat within the sayd
parish of Pembrey & County of Carmarthen aforesaid & now or late in
the tenure & occupation of my said sister Anne, myselfe & undertenants
or assignees I …….. large ample & beneficiall maner & forme as I the
said Oliver Mathew, the said Anne or any other person or persons doe
now occupy the premisses & enjoy the same, doe Have to Hold all &
singular the said premisses with the appurtenances unto the said Anne &
Mary Jenkin for & during the terme of both their naturall lifes &
the life of the Survivor of them if the said Mary jenkin shall too
long remane sole & unmarayed and if she the said Mary Jenkin shall
happen to marry in the life tyme of the said Anne, that……immediately
after such her intermarriage … to the immediate use benefitt
& behooste of the said Anne for & during her naturall life, after
her decease to my right heirs forever, and if the said Anne shall be
dead att such [?] the said Mary Jenkin into [?] marriage then to the immediate use & behooste
of my right heirs forever. And after the decease of the said Mary
Jenkin if she shall too long remaine sole & unmarryed [?] the use &
behooste of my right heirs forever. Item I give devise & bequeathe
unto Oliver Wales nephew to build a house in Cwm Issa with twenty
seaven yeards of land in lenghth adjoining to the house for to make
a garden & to have & to hold the same unto the said Oliver Wales for &
during the terme of his naturall life & noe further, payeing [?] unto the said
Anne & Mary or whoever shall lawfully enjoy the said premisses herein before
mentioned persuant to this my said will one dayes worke yearly & every year
if demanded any [?] thing [?] herein before contayned [?] …….ding to the contrary
in any wise notwithstanding . And lastly I give & bequeath all the rest
of my goods cattle & chatells moveable & immoveable whatsoever
unto my sister Anne & the said Mary Jenkin her reputed daughter
forever where I doe hereby nominat constitute & appoynt to be the
whole & sole Executrix [?] of this my last will & testament revoking all
former wills & testaments by me at any time heretofore made ……….
to be made & confirming this to be the laste noe other. In witnesse
